on the presence of members of the Association of Judges of Ukraine on a working visit to Germany, in the period from 11 to 17 September 2016

According to the work plan of the All-Ukrainian public organization “Association of Judges of Ukraine” for 2016, from September 11 to 17, with the financial and technical support of the German Fund for International Legal Cooperation (IRZ), a working trip was made to Germany in the city. Heidelberg on the exchange of experience of judges of Ukraine and judges and scholars of Germany on the topic: “European Convention for the Protection of Human Rights and Fundamental Freedoms”.

A delegation of members of the ACU consisting of 12 persons was sent to Germany, which included judges of the Supreme Specialized Court of Ukraine for the consideration of civil and criminal cases, the courts of appeal of the Donetsk region and the city of Kiev, the administrative court of appeal of the city of Kiev, the Golosiivskyi and Pechersky district courts.. Kyiv, headed by President of the Association of Judges of Ukraine Olena Ivanovna Yevtushenko, Judge of the Judicial Chamber for Civil Cases of the Supreme Specialized Court of Ukraine for the Consideration of Civil and Criminal Cases.

During the visit, the judges of Ukraine visited the Max Planck Institute of Foreign Public Law and International Law (m. Heidelberg, Germania), in which they had the opportunity to communicate professionally with the director of the institute, Professor Dr. The Mrs. Anne Peters.
Drs. Hartwig, an associate of the Institute, spoke about the main directions of the Institute's work, highlighted a number of theoretical issues regarding the application of the European Convention on Human Rights and the consideration of national courts of jurisprudence of the European Court of Human Rights and the consequences of non-compliance with it. Also discussed were the principles and approaches established by the European Court of Justice in resolving cases on the protection of honor, dignity and business reputation.

Drs. Hartwig answered questions from Ukrainian judges regarding the distinction between private life of an individual and public interest.

In addition, Ukrainian judges were present at the hearing of the Criminal Case (Professional Fraud) Court chaired by Judge Mr. Norbert Will, Following the announcement of the verdict in the case and the conclusion of the hearing, Mr. Norbert Will answered numerous questions from Ukrainian judges regarding the assessment of evidence, the qualification of the crime and the appointment of punishment.

During this visit, the members of the delegation visited the European Court of Human Rights in the city. Strasburgo (France), where they had the opportunity to familiarize themselves with the work of the European Court of Justice and were present in the courtroom during the proceedings of Satakunta Markkinporssi Oy and Satamedia Oy v. Finland (no.931/13).

After the end of the court session, the members of the delegation had the opportunity to meet with Ukrainian lawyers — employees of the European Court of Human Rights and received answers to questions about the progress of the case and the arguments of the parties.

Members of the delegation of the Association of Judges of Ukraine met with the retired judge of the Federal Supreme Court of Germany Dr. Beyer and had the opportunity to discuss with him the question “Interpretation of the law — biased by the application of law: Analogues of the law. Improving the qualification of judges” and considered on specific examples problematic issues regarding the independence of the judiciary in different countries.

During their stay in Germany, members of the ASU delegation participated in a cultural program planned by the German Foundation for International Legal Cooperation (IRZ).
