Working visit to Germany (m. Bonn) on the topic: “Pre-trial investigation and investigating judge”

In the period from June 11 to 16, 2019, with the financial and technical support of the German Fund for International Legal Cooperation (IRZ) members of the All-Ukrainian public organization “Association of Judges of Ukraine” made a working trip to Germany in the city. Bonn for the exchange of experience on the topic: “Pre-trial investigation and the investigating judge”.
A delegation of 10 ACU members was sent to Germany, which included judges of Kyiv and Chernivtsi courts of appeal, Mukachevo city district court of Transcarpathian region, Frankivsk district court of the city. Lviv, Holosiivskyi, Pechersk and Solomiansk district courts of the city. Kyiv, headed by President of the Association of Judges of Ukraine Olena Ivanovna Yevtushenko, Judge of the Judicial Chamber for Civil Cases of the Supreme Specialized Court of Ukraine for the Consideration of Civil and Criminal Cases.
At the beginning of the working visit, the members of the delegation had a meeting and the opportunity to communicate with the Director General of the Foundation for International Legal Cooperation (IRZ) Dr. Frauke Bachler, President of the Land Court of the city. In addition, members of the delegation had the opportunity to meet with the judge of the Königswinter District Court Dr. Jan Kraus. During the meeting there was a discussion of issues on the topic: “Pre-trial investigation from the point of view of the investigating judge”. During the discussion of judges of Ukraine, the system of the judiciary of Germany, the structure of judicial proceedings, functions and law enforcement were introduced; Dr. Jan Kraus in the introductory report highlighted the basic principles of criminal procedural law in Germany, the status and functions of the investigating judge during the investigation proceedings, the issues of further development and strengthening the procedural rights of the accused in the context of European integration, as well as the position of the participants in the process in the framework of the investigation proceedings.
Also, the members of the delegation had a meeting with the Managing Senior Prosecutor of the Retired Prosecutor's Office of the city. Bonn by Mr. Bernd-Gunter König, during which the issues on the topic: “Pre-trial investigation from the point of view of the prosecutor's office”, as well as the functions of the prosecution authorities in the investigation proceedings were discussed.
In addition, Mr. Bernd-Gunter König also covered in detail the issues of interaction and communication between the police authorities and the investigating judge during the investigation proceedings.
According to the results of the discussion, the members of the delegation received working materials on the issues covered.
During the visit, the judges of Ukraine were present at the court session of the Fourth Grand Chamber of the Land Court for the consideration of criminal cases (m. Bonn) for the consideration of a criminal case involving a jury regarding attempted arson, after which they had the opportunity to communicate with the presiding judge of the Land Court, Mr. Josef Janssen. Members of the delegation also had the opportunity to visit the courtrooms of the Land Court for the consideration of criminal cases and the premises of the court.
During their stay in Germany, members of the ASU delegation participated in a cultural program planned by the German Foundation for International Legal Cooperation (IRZ).
