December 14, 2017 in the city. In Chernihiv the All-Ukrainian NGO “Association of Judges of Ukraine” together with the National School of Judges of Ukraine and the German Foundation for International Legal Cooperation (IRZ) held a seminar on the topic: “Consideration by courts of cases on the protection of intellectual property, copyright cases, scientific discovery, industrial design, Trademark”.

The seminar was attended by: President of the Association of Judges of Ukraine V.O. Chairman of the High Specialized Court of Ukraine for Civil and Criminal Cases Yevtushenko Olena Ivanovna, Vice-Rector of the National School of Judges of Ukraine on Ensuring Organizational Activities Mazurok Volodymyr Antonovich, Chairman of the Court of Appeal of Chernihiv International Region Tagiev Sadig Rzayevich, representatives of the German Foundation legal cooperation (IRZ): legal adviser of the Glibko Foundation Natalia Vasylivna, judge of the High Land Court in the city. Frankfurt am Main dr. Ute Möckel (Germany), judge of the Land Court of Justice of Germany Munich dr. Oliver Schön (Germany), Judge of the HSSU Kafidova Olena Vasylivna, Judges of the Court of Appeal of Kyiv, Chernihiv and Donetsk Oblasts, Judges of Chernihiv District Administrative Court, Judges of the Commercial Court of Chernihiv Oblast, Judges of the District Courts of Chernihiv Chernihiv and Chernihiv region, judges of the city. Lviv, judges of Obukhiv and Fastiv district courts of Kyiv region, Ph.D., associate professor of Yaroslav Mudroho Kryzhna National Law University V.M. (m. Kharkov).

Welcoming words to the participants of the seminar were: President of the Association of Judges of Ukraine Olena Ivanovna Yevtushenko, Vice-Rector of the National School of Judges of Ukraine Mazurok Volodymyr Antonovich, Chairman of the Court of Appeal of Chernihiv Oblast Tagiev Sadig Rzaevich, Legal Counsel of the German International Foundation Legal Cooperation (IRZ) Natalia Glibko.

The seminar participants were provided with handout materials: an extract from the Civil Code of Ukraine, reports of German speakers dr. Ute Mokel and dr. Oliver Schona.The seminar participants were presented by: Chairman of the Court of Appeal of Chernihiv Oblast Tagiev Sadig with a report on the topic: “Justice in Chernihiv region: stages, problems, prospects”; judge of the Civil Chamber of the Supreme Specialized Court of Ukraine for the consideration of civil and criminal cases Elena Kafidova with a report on the topic: “Consideration of cases on the protection of copyright or other rights by the general jurisdiction”; Mrs. Dr. Ute Mokel with reports on the topic: “The emergence, content and transfer of copyright in Germany”, “Questions of evidence-case examples”; Mr. Dr. Oliver Schön with reports on: “Introduction to the German legal system of protection of intellectual property rights”, “Calculation of the amount of compensation”; Ph.D. Associate Professor of Yaroslav Mudroho Kryzhno Valentin National Law University with a report on the topic: “Abuse of intellectual property rights to a trademark”.

Judge of the Land Court of the City. Munich Dr. Oliver Schön and judge of the Supreme Court of the Land of the city. Frankfurt am Main Dr. Ute Mokel introduced Ukrainian colleagues to the basics of the German legal system of intellectual property protection; the essence, features of the emergence and transfer of copyright according to German legislation. In particular, Dr. Oliver Schön drew attention to the specialization of courts in Germany, which optimizes the consideration of specific categories of cases and contributes to the formation of sustainable judicial practice. He noted that consideration of the case on the protection of intellectual property rights is quite long and can be from 8 to 12 months from the moment of opening the case. In addition, oddly enough, when considering the relevant categories of cases, German judges very rarely turn to judicial experts for help. This is determined by the fact that the judges who consider such cases are not professional lawyers, but have a technical or other education.


In turn, the Chairman of the Court of Appeal of Chernihiv Oblast Sadih Tagiev familiarized the participants of the event with problematic aspects and prospects for the development of justice in Chernihiv region.
Participants of the seminar actively asked questions to fellow speakers, discussed and shared experiences. Of course, such measures contribute to professional growth and strengthening of cooperation between judges of Ukraine and judges of Germany.

The participants of the seminar expressed their gratitude to the organizers and speakers for the preparation and conduct of the seminar.

The total number of participants of the seminar is 47 people.

At the end of the seminar participants were issued a certificate.

At the invitation of the Chairman of the Court of Appeal of Chernihiv Oblast Tagiev Sadig Rzaevich, the participants of the seminar, headed by the President of the Association of Judges of Ukraine Elena Ivanovna, visited the Court of Appeal of Chernihiv Oblast, where there was a meeting with judges of the Court of Appeal and familiarization with the work of the court. Yevtushenko O.I. congratulated the court staff on the holiday — the Day of Court Workers of Ukraine and presented gifts on behalf of the Association.
